Kancelaria PMR Restrukturyzacje SA, in its capacity as Court Supervisor in the accelerated arrangement proceedings conducted against Property Lease Fund S.A. in restructuring with its registered office in Pozna\u0144, announces that a Meeting of Creditors was held on 14 and 15 November 2016.<\/p>\n

On 14 November 2016, the Commissioner Judge, pursuant to Article 97 of the Restructuring Law, approved the list of receivables and then held a vote at which the entitled Creditors supported the arrangement proposals with a two-thirds majority. Creditors representing claims in the amount of PLN 8,762,254.87 voted in favour of the arrangement proposals, while creditors representing claims in the amount of PLN 3,751,282.78 voted against the proposals.<\/p>\n

According to Article 107.1 of the Restructuring Law, unless the Act provides otherwise, the Creditors whose receivables have been included in the approved list of receivables have the right to vote at the Creditors' Meeting. In turn, Article 119.1 of the Restructuring Law states that resolution of the Meeting of Creditors<\/a> the decision on the acceptance of the arrangement is passed if the majority of voting Creditors who cast a valid vote and who have a total of at least two-thirds of the sum of the receivables owed to the voting creditors vote in favour of it.<\/p>\n

On November 15, 2016, at the Meeting of Creditors, the Judge-Commissioner, in accordance with Article 120.1 of the Bankruptcy Law The Restructuring Court issued a decision on the acceptance of the arrangement<\/a>.<\/p>\n

Zgodnie z art 107.1 Prawa Restrukturyzacyjnego, je\u017celi ustawa nie stanowi inaczej, na Zgromadzeniu Wierzycieli prawo g\u0142osu maj\u0105 Wierzyciele, kt\u00f3rych wierzytelno\u015bci zosta\u0142y umieszczone w zatwierdzonym spisie wierzytelno\u015bci. Z kolei art. 119. 1. Prawa Restrukturyzacyjnego stanowi, i\u017c uchwa\u0142a Zgromadzenia Wierzycieli o przyj\u0119ciu uk\u0142adu zapada, je\u017celi wypowie si\u0119 za ni\u0105 wi\u0119kszo\u015b\u0107 g\u0142osuj\u0105cych Wierzycieli, kt\u00f3rzy oddali wa\u017cny g\u0142os, maj\u0105cych \u0142\u0105cznie co najmniej dwie trzecie sumy wierzytelno\u015bci przys\u0142uguj\u0105cych g\u0142osuj\u0105cym wierzycielom.
