{"id":5832,"date":"2018-03-16T13:10:01","date_gmt":"2018-03-16T12:10:01","guid":{"rendered":"http:\/\/pmr-restrukturyzacje.local\/pmr\/przedsiebiorcy-nadal-nie-korzystaja-z-narzedzi-restrukturyzacyjnych\/"},"modified":"2018-03-16T13:10:01","modified_gmt":"2018-03-16T12:10:01","slug":"entrepreneurs-still-do-not-use-restructuring-tools","status":"publish","type":"post","link":"https:\/\/pmrsa.pl\/en\/entrepreneurs-still-do-not-use-restructuring-tools\/","title":{"rendered":"Entrepreneurs still not using restructuring tools"},"content":{"rendered":"<p>According to estimates, up to tens of thousands of companies in Poland annually undertake internal repair, rescue measures, but only a few percent of them take advantage of the legal protection and tools that the new Restructuring Law puts at their disposal. Why?<\/p>\n<p>The second year of operation of the amended provisions of the Restructuring and Bankruptcy Law has passed, significantly increasing the chances of saving companies in Poland. Despite the provision of new rescue tools to entrepreneurs, protection periods against aggressive debt collection activities <a href=\"https:\/\/pmrsa.pl\/en\/negotiations-with-creditors-in-the-restructuring-process-whether-mediation-helps-in-restructuring-the-company\/\">creditors and professionalization of the restructuring process<\/a>, Polish entrepreneurs still very rarely use such assistance. According to data provided by Coface &quot;Bankruptcies and restructuring <a href=\"https:\/\/pmrsa.pl\/en\/despite-the-crisis-companies-in-poland-do-not-give-up-on-investing-in-it\/\"  data-wpil-monitor-id=\"482\">companies in Poland<\/a> in 2017\u201d last year there were 537 bankruptcies and 348 restructurings of companies, with a total of 885 initiated proceedings, which is only a 16 percent increase compared to 2016.<\/p>\n<p>This is a very small increase even considering that <a href=\"https:\/\/pmrsa.pl\/en\/record-number-of-consumer-bankruptcies-in-2023-or-will-2024-bring-changes\/\"  data-wpil-monitor-id=\"217\">the number of restructurings is growing faster than bankruptcies<\/a> \u2013 in 2016, out of the total number of proceedings, 27 percent were <a href=\"https:\/\/pmrsa.pl\/en\/restructuring\/\"  data-wpil-monitor-id=\"1816\">restructuring<\/a>, and in 2017 \u2013 39 percent. Among the proceedings <a href=\"https:\/\/pmrsa.pl\/en\/amendment-to-the-restructuring-agreement\/\"  data-wpil-monitor-id=\"1195\">restructuring proceedings, the most common are accelerated arrangement proceedings<\/a> (209), and the fewest proceedings for approval of the arrangement (11).<\/p>\n<div class=\"ramka1\">\u2013 Entrepreneurs most often reach for accelerated <a href=\"https:\/\/pmrsa.pl\/en\/variation-proceedings-part-2\/\"  data-wpil-monitor-id=\"64\">composition proceedings<\/a>, because they enable the quickest possible development of an arrangement with creditors if the crisis is not in an advanced phase and the main problems come down to disruption of liquidity \u2013 says S\u0142awomir Anisimowicz, Managing Director of PMR Restrukturyzacje SA \u2013 The second most frequently used tool is the restructuring procedure, which in turn enables the implementation of profound changes in the scope of the conducted operational activity, in practically every aspect, including remodelling or even changing the significant directions of conducting the activity \u2013 he adds.<\/div>\n<p>Why are there so few of these proceedings in Poland, when experts estimate that there are as many as tens of thousands? <a href=\"https:\/\/pmrsa.pl\/en\/restructuring-law-has-been-saving-polish-companies-for-a-year\/\"  data-wpil-monitor-id=\"1502\">companies in Poland introduce various internal restructuring measures every year<\/a>, and several thousand have serious temporary problems?<\/p>\n<div class=\"ramka1\">-Very low number <a href=\"https:\/\/pmrsa.pl\/en\/restructuring-companies-through-the-eyes-of-entrepreneurs\/\"  data-wpil-monitor-id=\"1376\">restructuring is the result of the still insufficient knowledge of entrepreneurs<\/a> \u2013 says S\u0142awomir Anisimowicz. \u2013 In Poland, in addition, unlike in Western countries, we are dealing with fear of admitting to problems. The introduction of open restructuring activities by the company for many <a href=\"https:\/\/pmrsa.pl\/en\/instead-of-going-bankrupt-entrepreneurs-fight-and-restructure-their-businesses\/\"  data-wpil-monitor-id=\"512\">entrepreneurs and their business partners<\/a>, financial institutions, and customers is often a negative signal, even a sign of bankruptcy.
