Before deciding to buy, however, it is worth knowing the transaction process inside out to find out what a buyer can expect.<\/p>\n<p>In the event of a declaration of bankruptcy, the assets of a debtor who is an entrepreneur or a consumer become the bankruptcy estate. It consists of all rights and things belonging to him on the day of its declaration, including the debtor&#039;s right <a href=\"https:\/\/pmrsa.pl\/en\/a-share-in-the-amount-of-pln-%c2%bd-in-the-ownership-right-to-an-undeveloped-real-estate-located-in-koscielnik-on-plot-no-642-2\/\"  data-wpil-monitor-id=\"1770\">ownership of real estate<\/a>, the right of perpetual usufruct, cooperative ownership right to premises, share in co-ownership of things and rights. Thus, the debtor loses the right to manage and use the property included in the bankruptcy estate and to dispose of it, which in practice means that it is impossible to sell the real estate or premises or conclude a lease or tenancy agreement. So how can you buy property from a debtor who has declared bankruptcy?<\/p>\n<p><b>Inventory and subsequent liquidation of assets<\/b><\/p>\n<p>The next step after declaring bankruptcy is for the trustee to prepare an inventory. Based on this inventory, an estimate is made. <a href=\"https:\/\/pmrsa.pl\/en\/consumer-bankruptcy-without-debt-but-also-without-assets\/\">bankruptcy estate assets<\/a>, which the debtor had on the day the court issued a decision on its announcement. Determining the assets and their value is necessary to prepare the process of liquidation of the bankruptcy estate. However, before it can take place, the judge-commissioner must approve the terms of sale.<\/p>\n<div class=\"ramka1\">- Determining and then estimating the value of all assets included in the bankruptcy estate, both movable and immovable, allows the trustee to plan and prepare the liquidation process of the bankruptcy estate in a way that allows the bankrupt's assets to be sold without collision and the statutory deadlines for conducting the liquidation to be met<br \/>\n- explains Ma\u0142gorzata Anisimowicz, President of PMR Restructurings SA.<\/div>\n<p>In the case of real estate, the regulations provide for the possibility of their sale by tender, auction or free-hand sale. \u2013 The basic form of sale in bankruptcy proceedings is a public tender, which is conducted by the trustee and supervised by the judge-commissioner. (...) The next method of liquidating the bankruptcy estate is free-hand sale. However, this does not mean that it is a completely arbitrary and unregulated process. Tym samym d\u0142u\u017cnik traci prawo zarz\u0105du i korzystania z mienia wchodz\u0105cego w sk\u0142ad masy upad\u0142o\u015bci i rozporz\u0105dzania nim, co w praktyce oznacza brak mo\u017cliwo\u015bci sprzeda\u017cy nieruchomo\u015bci lub lokalu czy zwarcia umowy najmu lub dzier\u017cawy. W jaki spos\u00f3b zatem kupi\u0107 maj\u0105tek od d\u0142u\u017cnika, kt\u00f3ry og\u0142osi\u0142 upad\u0142o\u015b\u0107? Spis inwentarza, a potem likwidacja maj\u0105tku Krokiem nast\u0119puj\u0105cym po og\u0142oszeniu upad\u0142o\u015bci jest sporz\u0105dzenie spisu inwentarza przez syndyka. Na jego podstawie nast\u0119puje oszacowanie maj\u0105tku masy upad\u0142o\u015bci, kt\u00f3r\u0105 d\u0142u\u017cnik posiada\u0142 na dzie\u0144 wydania przez s\u0105d postanowienia o jej og\u0142oszeniu. Ustalenie sk\u0142adnik\u00f3w maj\u0105tkowych oraz ich warto\u015bci jest konieczne do przygotowania procesu likwidacji masy upad\u0142o\u015bci. Zanim jednak do niego dojdzie, s\u0119dzia-komisarz musi zatwierdzi\u0107 warunki sprzeda\u017cy. \u2013 Ustalenie, a nast\u0119pnie oszacowanie warto\u015bci wszystkich sk\u0142adnik\u00f3w maj\u0105tkowych wchodz\u0105cych do masy upad\u0142o\u015bci, zar\u00f3wno ruchomo\u015bci, jak i nieruchomo\u015bci, pozwala syndykowi zaplanowa\u0107 i przygotowa\u0107 proces likwidacji masy upad\u0142o\u015bci w spos\u00f3b, kt\u00f3ry pozwoli na bezkolizyjn\u0105 sprzeda\u017c maj\u0105tku upad\u0142ego i zachowanie ustawowych termin\u00f3w prowadzenia likwidacji \u2013 wyja\u015bnia Ma\u0142gorzata Anisimowicz, prezes PMR Restrukturyzacje SA.
