To meet the crisis situation of companies, the government simplified the restructuring procedure. Today, it is already clear that the solution introduced meets the needs of companies and is proving to be very useful.<\/p>\n

The simplified arrangement approval procedure, known as the simplified restructuring procedure (SPR), is predominantly an out-of-court procedure.<\/p>\n

\u2013 This procedure, aimed at approving the arrangement with creditors and protecting the company's assets and key contracts, is carried out on the basis of an agreement with restructuring advisor<\/a>, and the day of the announcement in the Court and Economic Monitor is the day of opening the proceedings for approval of the arrangement. From that day also begins the four-month period for concluding an arrangement with creditors \u2013 <\/i>explains Ma\u0142gorzata Anisimowicz, qualified restructuring advisor and CEO PMR Restructuring<\/a>, a company with extensive experience in conducting restructuring proceedings.<\/p>\n

\u2013 Start of simplified restructuring companies by operation of law result in suspension<\/a> enforcement proceedings, both with respect to receivables arising before the opening of the proceedings and included in the arrangement, as well as with respect to receivables secured in kind. It is also inadmissible to initiate new enforcement proceedings. It is also inadmissible to terminate lease or tenancy agreements, leasing agreements, property insurance agreements or bank account agreements without the consent of the arrangement supervisor. <\/i>- points out Malgorzata Anisimowicz.<\/p>\n

Od tego dnia rozpoczyna r\u00f3wnie\u017c bieg czteromiesi\u0119czny termin na zawarcie uk\u0142adu z wierzycielami \u2013 t\u0142umaczy Ma\u0142gorzata Anisimowicz, kwalifikowany doradca restrukturyzacyjny i prezes zarz\u0105du PMR Restrukturyzacje, sp\u00f3\u0142ki z du\u017cym do\u015bwiadczeniem w prowadzeniu post\u0119powa\u0144 restrukturyzacyjnych. \u2013 Rozpocz\u0119cie uproszczonej restrukturyzacji firmy z mocy prawa powoduje zawieszenie post\u0119powa\u0144 egzekucyjnych, zar\u00f3wno co do wierzytelno\u015bci powsta\u0142ych przed otwarciem post\u0119powania i wchodz\u0105cych do uk\u0142adu, jak i co do wierzytelno\u015bci zabezpieczonych rzeczowo.
