A partial arrangement may only be concluded as part of two restructuring procedures - the arrangement approval procedure and the accelerated arrangement procedure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The claims covered by the partial arrangement must be distinguished on the basis of a clear, objective and economically justifiable criterion. These may be, in particular, claims:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>from financing activities through loans, credits;<\/strong><\/li>\n\n\n\n<li><strong>on account of essential contracts, e.g. leases, rents, supplies;<\/strong><\/li>\n\n\n\n<li><strong>largest by volume;<\/strong><\/li>\n\n\n\n<li><strong>from public-law debts, e.g. social security contributions or taxes<\/strong><\/li>\n\n\n\n<li><strong>secured by mortgage, pledge, registered pledge<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Proceedings shall only cover and be conducted in respect of a part of the isolated claims enabling the <a href=\"https:\/\/pmrsa.pl\/en\/what-characterizes-good-cooperation-between-an-entrepreneur-and-a-restructuring-advisor-how-to-choose-a-restructuring-advisor-or-wait-for-the-court-to-indicate-someone-to-us\/\" title=\"\">entrepreneur uninterrupted continuation of the remaining business and cooperation<\/a> with counterparties not covered by the agreement. This is <a href=\"https:\/\/pmrsa.pl\/en\/new-solutions-to-save-failing-companies\/\" title=\"\">a solution for companies<\/a>who need to restructure only selected liabilities and fear negative repercussions from permanent collaborators in the case of comprehensive proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>","protected":false},"excerpt":{"rendered":"<p>A partial arrangement is an agreement that can be concluded only with certain creditors or a group of creditors, enabling the restructuring of receivables that have a fundamental impact on the continued operation of the enterprise.
