In the context of the transparency of such entities, the question arises: are the registration files of a family foundation available for everyone to view?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Family foundations are entered into a dedicated register of family foundations maintained by the District Court in Piotrk\u00f3w Trybunalski. The register is public, but access to registration information is limited. Importantly, the register is not available in the IT system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Within the scope of public information<\/strong> regarding the family foundation, to which everyone has access, include in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>name of the foundation, its registered office, address, NIP and REGON numbers,<\/li>\n\n\n\n<li>the amount of the founding fund,<\/li>\n\n\n\n<li>data of members of the foundation\u2019s bodies,<\/li>\n\n\n\n<li>the founder\u2019s name and surname and correspondence address, if the founder is entitled to appoint the management board,<\/li>\n\n\n\n<li>the duration of the foundation, if specified,<\/li>\n\n\n\n<li>data regarding the foundation&#039;s statute,<\/li>\n\n\n\n<li>fiscal year,<\/li>\n\n\n\n<li>subject of the foundation&#039;s activities.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">However, not all documents related to a family foundation are public. Internal records, such as the foundation&#039;s statute, the list of beneficiaries, or details about the foundation&#039;s assets, are legally protected and not available to outsiders. <strong>Only authorized persons have access to these documents<\/strong>, such as founders, beneficiaries, foundation bodies and selected administrative bodies and, importantly, persons who demonstrate their legal interest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is worth noting that this regulation differs from the one applicable to commercial law companies, where the registration files are publicly available to anyone interested. In contrast to the access to the registers maintained within the National Court Register, where commercial law companies are entered, access to information regarding a family foundation <strong>is not possible via the website<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This legal structure allows for a balance between transparency and privacy protection. W zakres informacji jawnych dotycz\u0105cych fundacji rodzinnej, do kt\u00f3rych ka\u017cdy ma dost\u0119p, wchodz\u0105 w szczeg\u00f3lno\u015bci: Jednak nie wszystkie dokumenty zwi\u0105zane z fundacj\u0105 rodzinn\u0105 s\u0105 publiczne. Akta wewn\u0119trzne, takie jak statut fundacji, lista beneficjent\u00f3w czy szczeg\u00f3\u0142y dotycz\u0105ce maj\u0105tku fundacji, podlegaj\u0105 ochronie prawnej i nie s\u0105 dost\u0119pne dla os\u00f3b postronnych. Dost\u0119p do tych dokument\u00f3w maj\u0105 jedynie uprawnione osoby, takie jak fundatorzy, beneficjenci, organy fundacji i wybrane organy administracyjne oraz, co istotne, osoby, kt\u00f3re wyka\u017c\u0105 sw\u00f3j interes prawny. Warto zauwa\u017cy\u0107, \u017ce ta regulacja r\u00f3\u017cni si\u0119 od obowi\u0105zuj\u0105cej w stosunku do sp\u00f3\u0142ek prawa handlowego, gdzie akta rejestrowe s\u0105 publicznie dost\u0119pne dla ka\u017cdego zainteresowanego. W przeciwie\u0144stwie do wgl\u0105du w rejestry prowadzone w ramach KRS, gdzie wpisywane s\u0105 sp\u00f3\u0142ki prawa handlowego, wgl\u0105d w informacje dotycz\u0105ce fundacji rodzinnej nie jest mo\u017cliwy za po\u015brednictwem strony internetowej. Taka konstrukcja prawna pozwala na zachowanie r\u00f3wnowagi mi\u0119dzy przejrzysto\u015bci\u0105 a ochron\u0105 prywatno\u015bci.
